1. Acceptance of Terms

Hey there, welcome to DateFlo. We're glad you're here. These Terms of Service ("Terms") are the agreement between you and DateFlo ("we," "us," or "our") that governs how you use our website, app, and everything we offer (the "Service"). By using DateFlo, you're agreeing to these Terms and our Privacy Policy.

We know legal pages aren't the most exciting read, but they're important. If anything here doesn't sit right with you, please reach out, and if you can't agree, we'd ask that you hold off on using the Service.

2. What DateFlo Does

DateFlo is a personalized date planning platform. We create curated, multi-stop date itineraries built around your preferences, city, budget, and relationship. Here's what that looks like:

  • Custom date plans tailored to your tastes, dietary needs, and vibe as a couple.
  • Hand-picked venue and activity recommendations researched specifically for each plan.
  • Timing, logistics, and practical tips so you never have to guess what comes next.
  • Reservations booked for you: when your plan includes a table, our team handles the booking so you never have to pick up the phone.
  • Your plans delivered straight to your dashboard and inbox.
  • A place to track your date history and save favorites.
  • Photo storage so you can hold onto those memories.

A quick but important note: while we book reservations and handle the legwork for you, we don't own or operate the venues we recommend, and we're not a travel agency or event organizer. We arrange reservations as a courtesy, and we can't guarantee that every venue will honor a booking, stay open, keep the same menu, or run perfectly on the night. We do our homework and we'll flag anything worth confirming, but the venues themselves are outside our control.

3. Your Account

3.1 Creating an Account

Anyone can create a DateFlo account. Standard and Pro are open to everyone with self-serve signup and checkout. Concierge is different: it's offered by application, and we approve each request personally so we can keep that experience truly white glove. Your account is personal to you, and we may limit or decline accounts at our discretion as we manage how DateFlo grows.

3.2 You Need to Be 18+

DateFlo is built for adults. You need to be at least 18 years old to create an account. We ask for your date of birth once, when you first set up your account, and we use it to check this and to know when your birthday is worth planning around. If we find out an account belongs to someone under 18, we'll close it right away.

3.3 What You Tell Us About Your Partner

DateFlo only works because you tell us about the two of you, which means you give us information about someone else: their name, what they like to eat, what they cannot eat, how they like to be shown affection, and sometimes when they are free. Your partner has not signed these terms, and we take that seriously.

So, when you give us information about your partner, you are confirming that you have their permission to share it and that what you tell us is accurate. Please only share what they would be comfortable with you sharing. Do not enter anything about a third party who is not your partner.

Your partner has the same rights over their own information that you have over yours. If they join your account with your pairing code, they can see and change what is on file about them. If they never join, they can still email admin@dateflo.com and ask us what we hold about them, ask us to correct it, or ask us to delete it, and we will do that whether or not you agree.

3.4 Keep Your Info Accurate

When you sign up, please use real, accurate information, and keep it up to date. Your account is your responsibility, including everything that happens under it and keeping your login credentials secure.

3.5 Let Us Know If Something's Wrong

If you ever notice suspicious activity on your account, reach out to us immediately at admin@dateflo.com. We'll do everything we can to help, but we can't be responsible for issues that come from a compromised password on your end.

3.6 One Account Per Person

Please stick to one account. Creating multiple accounts to game promotions or credits isn't allowed, and we may close all associated accounts if we catch it.

4. Your Content, Your Data

4.1 You Own It

Everything you bring to DateFlo (your preferences, photos, feedback, comments) is yours. We don't claim ownership over any of it. By sharing it with us, you're giving us permission to use it for one purpose: making your experience better. That means storing it, processing it, and personalizing the Service around it. Nothing more.

4.2 Keep It Clean

We ask that you don't submit anything unlawful, harassing, or otherwise harmful. If we find content that crosses the line, we reserve the right to remove it.

4.3 Want Your Data? Just Ask.

You can request a full copy of your personal data anytime by emailing admin@dateflo.com. We'll get it to you in a standard, readable format within 30 days.

5. Things You Can't Do

We want to keep DateFlo a great experience for everyone. Please don't:

  • Use DateFlo for anything illegal or in violation of any laws.
  • Pretend to be someone you're not or misrepresent who you are.
  • Try to access other people's accounts or break into our systems.
  • Use bots, scripts, or automated tools to interfere with or disrupt the Service.
  • Scrape, mine, or extract data from DateFlo without our written permission.
  • Copy, resell, or commercially exploit any part of the Service without permission.
  • Send viruses, malware, or any harmful code through our platform.
  • Harass, threaten, or abuse other users or our team.
  • Use DateFlo to promote violence, discrimination, or illegal activity.
  • Share your login with others or let someone else use your account.
  • Try to get around our payment systems, access controls, or usage limits.

If any of these are violated, we may suspend or close your account, and in serious cases, take legal action.

6. Intellectual Property

6.1 Our Stuff

The DateFlo platform (our website, app, designs, code, algorithms, date plan formats, and all the content we create) belongs to us and is protected by intellectual property laws. Please don't copy, modify, sell, or redistribute any of it without our written permission.

6.2 Our Brand

"DateFlo," our logo, and all related branding are our trademarks. You're welcome to talk about us, but please don't use our marks in a way that implies endorsement or affiliation without asking first.

6.3 Your Date Plans

The date plans we create for you are for your personal enjoyment. Share them with your partner, absolutely. That's the whole point. But please don't reproduce, redistribute, or sell them.

6.4 Your Stuff Is Still Yours

Just to be clear: your personal data, photos, preferences, and content remain yours, as we covered in Section 4. This section is about the platform itself.

7. Payments and Pricing

7.1 How Credits Work

DateFlo runs on a simple credit system. You buy credits, and each date plan uses one. Pricing is shown at checkout and may change over time, but any credits you've already purchased stay at the price you paid.

7.2 Subscriptions

We may offer subscription plans that give you a recurring set of credits or extra features. If you subscribe, we'll be upfront about the pricing, billing cycle, and what's included. Subscriptions renew automatically unless you cancel before the next cycle. You can cancel anytime through your settings or by reaching out to us.

7.3 Gift Cards and Promo Credits

From time to time, we may offer gift cards or promotional credits. Gift cards are non-refundable and can't be cashed out (unless the law says otherwise). Promo credits may come with expiration dates or restrictions, which we'll make clear when they're issued. Neither can be resold.

7.4 Payment Security

All payments go through Stripe, which means we never see or store your full card number. Your payment info goes directly to Stripe and is handled under their Terms of Service. Please make sure you're authorized to use whatever payment method you provide.

7.5 Taxes

Depending on where you live, taxes may apply on top of the listed price. Those are on you. We'll do our best to make it clear at checkout.

7.6 Free First Date

Your very first date plan is completely free. No credit card required, no strings attached. Once you've joined with an invitation, we want you to experience DateFlo before you spend a dime.

7.7 Refunds

If a night never happened, you should not be paying for it. Our policy:

  • If you have not used what you paid for: any date plan you bought and have not used is refundable in full.
  • If your membership renewed while you were away: we refund the unbroken run of billing periods right before your request in which you did not plan a date. If you planned a date part way through that stretch, the run ends there, and the periods before it are no longer refundable.
  • If we have not delivered: if you requested a plan and it has not arrived, cancel it and the credit comes back in full.
  • Partial usage: if you used some but not all of the plans you purchased, we refund the unused ones. Buy 3, use 1, and 2 come back.
  • Cancelling: cancelling stops the next renewal. Your membership, and any credits already in it, stay usable through the period you have paid for.
  • Gift card refunds are handled case by case.

7.8 Where Your Refund Actually Comes From

This depends on where you bought, and we would rather be plain about it than let you find out later.

  • Bought on dateflo.com: we refund you directly. Email admin@dateflo.com and it is normally processed within 5 to 10 business days.
  • Bought inside the iPhone app: the purchase is processed by Apple, and only Apple can refund it. We cannot reverse an App Store charge no matter how much we agree with you. What we can do, and do: the app has a Request a refund button that opens Apple's own form, and when Apple asks us whether you used what you paid for, we tell them the truth from your account and ask them to grant it when you did not. If Apple declines anyway, we put the same value back into your DateFlo account as unused date credits, which do not expire.

7.9 Subscriptions Bought in the App

Memberships purchased inside the iPhone app renew automatically each month, at the price shown before you buy, charged to your Apple ID, until you cancel. The one night purchase does not renew. Cancel at least 24 hours before the next renewal, from Settings in the app under Manage subscription, or in your Apple ID subscription settings. Cancelling stops the next charge; it does not refund the period you are in. One membership covers both partners in a couple, so refunding it ends the plans for both accounts from the refunded period onward.

7.10 Flowers and Gifts

When you order flowers through DateFlo, we buy them on your behalf from a third party florist and have them delivered where you tell us. The price you are quoted is the full price you pay: the bouquet, the florist's delivery fee, sales tax, and our fee for arranging it, shown as one number with nothing added at checkout.

Because a person places the order by hand, orders must be placed at least 24 hours before delivery, and the flowers themselves are the florist's to deliver, not ours. Substitutions of a similar or greater value are normal in the florist trade and are not a fault. If a delivery fails, arrives on the wrong day, or arrives in poor condition, tell us and we will pursue it with the florist and refund you what we cannot fix. Orders can be cancelled for a full refund up to the 24 hour cutoff; after that the flowers are already being made.

8. What We're Responsible For (and What We're Not)

8.1 No Guarantees

We put real effort into every plan, but DateFlo is provided "as is." We can't guarantee that every recommendation will be perfect, every venue will be open, or every detail will be 100% accurate at the time of your date.

8.2 About the Venues and the Reservations We Make

Our recommendations are based on thorough research, and when your plan includes a reservation, our team books it for you. Even so, the real world is unpredictable, so we can't be responsible for:

  • A restaurant closing early or changing its hours.
  • A venue cancelling, losing, or failing to honor a reservation we made.
  • Menu changes, price increases, or food quality on a given night.
  • How a venue's staff treats you on your visit.
  • Safety conditions at any location or during any activity.
  • Outdated addresses, phone numbers, or website links.
  • Rain, heat waves, or anything else Mother Nature throws your way.

We book reservations as a courtesy to save you the hassle, but we can't guarantee a venue will honor every booking. If your plans change, any cancellation, deposit, or no-show fee the venue charges is between you and the venue, so please cancel directly with them if you can't make it. We'll always recommend confirming hours and details before you go. At the end of the day, you're the one stepping through the door, so please use your own judgment too.

8.3 Limitation of Damages

To the fullest extent the law allows, DateFlo and its team won't be liable for any indirect, incidental, special, or consequential damages (things like lost profits, lost data, or other intangible losses) that come from using (or not being able to use) the Service.

If it ever comes to a claim, our total liability is capped at whichever is greater: what you've paid us in the past 12 months, or $50.

9. You've Got Our Back Too

If something goes wrong because of how you used DateFlo (say, a Terms violation, a third-party dispute, or something that happened at a venue) you agree to cover us. That means you'll defend and hold harmless DateFlo and our team from any claims, losses, or legal fees that arise from:

  • Your use of the Service or anything that happens under your account.
  • Breaking any of these Terms.
  • Violating anyone else's rights.
  • Content you submit to DateFlo.
  • Your behavior at any venue or activity we recommended.

This responsibility sticks around even if you delete your account.

10. Closing Your Account

10.1 If You Want to Leave

You can delete your account whenever you want, either through your dashboard settings or by emailing admin@dateflo.com. We'll remove your personal data as outlined in our Privacy Policy. No hard feelings.

10.2 If We Need to Step In

We hope it never comes to this, but we reserve the right to suspend or close your account if we believe you've violated these Terms, are causing harm to others, or are misusing the platform. We may also close long-inactive accounts after giving you a heads-up.

10.3 What Happens After

  • Once an account is closed, you lose access to the Service.
  • If we closed it because of a Terms violation, unused credits may be forfeited.
  • If you chose to leave on your own, you can request a refund on unused purchased credits.
  • Some parts of these Terms (like Sections 6, 8, 9, 11, and 12) stick around even after your account is gone.

11. If There's a Problem

11.1 Let's Talk First

If something goes wrong, we'd love the chance to fix it directly. Before going the formal route, please reach out to us at admin@dateflo.com and give us at least 30 days to work it out. Most issues can be resolved with a conversation.

11.2 Binding Arbitration

If we can't resolve things informally, both you and DateFlo agree to settle the matter through binding arbitration with the American Arbitration Association (AAA) under their Consumer Arbitration Rules. A single arbitrator will handle it, and it can take place where you live, or by phone, video, or written submission if you prefer. The decision is final.

11.3 No Class Actions

YOU AND DATEFLO AGREE THAT ANY CLAIMS WILL BE BROUGHT INDIVIDUALLY, NOT AS PART OF A CLASS ACTION OR GROUP PROCEEDING. The arbitrator can't combine multiple people's claims or oversee any class or representative action.

11.4 Exceptions

Either side can go to court to protect intellectual property rights or pursue claims that qualify for small claims court.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. If arbitration doesn't apply for some reason, we both agree to the jurisdiction of Delaware's state and federal courts.

13. Updates to These Terms

We may update these Terms as DateFlo grows and evolves. If we make meaningful changes, we'll update the date at the top of this page and give you at least 14 days' notice, by email or an in-app notice, before they kick in. If the changes don't work for you, you're free to stop using the Service and request account deletion.

14. The Fine Print

14.1 Entire Agreement

These Terms, along with our Privacy Policy, make up the full agreement between you and DateFlo. They replace any previous agreements or conversations.

14.2 Severability

If a court finds any part of these Terms unenforceable, the rest still stands. We'll adjust the problematic part just enough to make it work while keeping the spirit of it intact.

14.3 Waiver

If we don't enforce a particular right or provision at some point, that doesn't mean we've given it up.

14.4 Assignment

You can't transfer your account or these Terms to someone else without our permission. We may transfer ours as part of a business change, and these Terms will carry over.

14.5 Force Majeure

We can't be held responsible for delays or failures caused by things genuinely outside our control: natural disasters, pandemics, wars, power outages, internet failures, cyberattacks, or similar events.
